Obama's health care aid to small firms disappoints

WASHINGTON (AP) ? Many small businesses struggle to afford health insurance for their workers, but a a new tax credit meant to help them seems to be turning into a disappointment.

Although opinion polls show the credit is one of the most popular ideas in President Barack Obama's health care law, only 170,300 businesses out of a pool of as many as 4 million potentially eligible claimed it in 2010, about 4 percent.

A recent government report found the tax credit time-consuming to apply for and not rewarding enough to be financially attractive.

That's put the Obama administration in the awkward position of asking Congress to help fix the problems by allowing more businesses to qualify and making it simpler to apply. But Republicans who run the House say they want to repeal what they deride as "Obamacare," not fix its flaws.

"They completely missed the target on this thing," Rep. Sam Graves, R-Mo., said of the tax credit. "I don't think expanding it is going to make any difference whatsoever." Graves chairs the House Small Business Committee.

It doesn't help the administration's plea that the biggest small-business lobbying group is a lead plaintiff asking the Supreme Court to overturn the Affordable Care Act. The National Federation of Independent Business isn't likely to spend much time tinkering with the tax credit or promoting it to members.

Small businesses represent the crumbling edge of the nation's system of employer-based health care. Only about 30 percent of companies with fewer than 10 workers offer health coverage, and they often pay more for insurance than large businesses. The credit, which once had support from lawmakers of both parties, was supposed to help businesses already providing coverage afford the premiums. Maybe it would even entice some to start.

"We agree it is not a panacea for all costs," said John Arensmeyer, founder of Small Business Majority, an advocacy group that supports the health care law and disagrees with the much larger independent business federation. The problem is all the negative publicity around the health care law has discouraged business owners from applying for the credit, he says.

"There has been more heat than light shone on this," Arensmeyer said. "There is no reason why small businesses shouldn't be taking advantage of this credit." About 770,000 workers were covered by the businesses claiming the credit in 2010.

The administration says word is finally getting out, and it expects the number of companies claiming the credit for 2011 to more than double, reaching 360,000 businesses.

A recent report by Congress' nonpartisan Government Accountability Office identified several problems with the program.

To begin with, the GAO said, the tax credit is structured so its biggest benefits go to very small companies paying low wages. About 4 out of 5 such businesses don't offer coverage, and the tax credit is not sufficient to encourage them to start doing so.

"Small employers do not likely view the credit as a big enough incentive to begin offering health insurance," the report said.

The average credit claimed in 2010 was about $2,700, although some companies qualified for much more.

Many small firms did not qualify because they paid fairly decent wages. The GAO report quoted an unidentified tax preparer who explained that "people get excited that they're eligible and then they do the calculations and it's like the bottom just falls out of it and it's not really there." It's almost a bait and switch.

Complexity has been another obstacle. IRS Form 8941, which employers must complete to claim the credit, has 25 lines and seven worksheets, the GAO said. Some tax preparers told the agency it took clients from two to eight hours to pull together supporting information and tax professionals another three to five hours to calculate the credit.

Trying to help, the IRS identified "three simple steps" employers needed to follow, but the GAO found "the three steps become 15 calculations, 11 of which are based on seven worksheets, some of which request multiple columns of information."

Arensmeyer said claiming the credit will be simpler once it becomes standard in tax-preparation software.

If the health care law withstands Supreme Court scrutiny, more employers could start claiming the credit. Even so, time is running short. After 2014, the credit is only available for two years. It may just go down as a missed opportunity, for policymakers and small-business owners alike.

Business Wisdom Within: Change Agents Must be Bold

Change initiatives often come more from vision and desire, than from a solid plan.? Change agents, either organizational leaders or selected agents of the vision, must act boldly in the absence of detailed planning.

Though it is very common for business initiatives that drive change in business culture or direction to lack detailed planning, I find it difficult to concisely explain the phenomenon.? There seem to be a great number of reasons for it, and many of them show up all at once inside of any given organization.

Here are a few.

  • Leaders don?t always know how to plan a behavioral or cultural change
  • Leaders hire or assign experts, but that expertise is geared more toward technical know-how than change management
  • We know what we want, but the path from A to B is not always clear
  • Changing organization structure and metrics is relatively easy, but performance comes from changing behavior, which is hard
  • Most of us have never been trained how to plan performance change through changing behavior
  • Leaders engage consultants to advise, but consultants don?t intimately know or understand the business culture
  • Sometimes we don?t realize that we need to change in order to improve, so we don?t plan on it occurring

I?m sure that with the above food for thought, the reader can add his or her own insights to the list.? The bottom line is that when we drive an initiative to improve business performance, something must change.? Our leaders expect and demand the change, but we often don?t have the benefit of a plan for how that change will occur.

Agents of the internal business change can represent a wide variety of roles.? We can be the executive leader, middle managers tasked to make it happen, or we can be individual contributors tapped on the shoulder to exercise our skills and influence to facilitate the change.

Not one of the roles mentioned is truly positioned to build a detailed change plan alone.? The executive is often too far removed from actual challenges and behavior to build an insightful plan.? Middle managers are stuck asking for permission and managing multiple authorities and expectations.? Individual contributors have no real authority at all.

So, as change agents in any of these roles, or any other, what are we to do?? I suggest two courses of action to take.? Both of them require boldness and initiative and a great deal of interpersonal influence. (Don?t worry; the simple fact that you were chosen implies that you have lots of each.)

First, work with your organizational leaders and contributors to identify holes in the current plan and begin filling them.? I know that it sounds obvious, but because of uncertainty on all fronts about what to do, we often don?t feel comfortable doing it.? Our impulse is to wait for instructions or to pray for inspiration.

Be bold.? Be courageous.? Be understanding.? Understand that the reason we don?t have the direction we would like is probably because those around us are just as uncertain about what is required as are we.? Approach them humbly and with a plan.

It does no good to point out problems and stand and wait for solutions.? Chances are, if we are the first to see the problem, then we understand it or feel it more than anyone else.? Therefore, we are probably the most qualified to propose a solution.? Do so.?

While we are waiting for others in the organization to catch up to meeting our needs for direction, or to digest our proposals for how to fill in the planning gaps, we can?t just twiddle our thumbs.? We are still trying to drive a change and momentum is vital.? We can?t pause.

Therefore, the second thing we must do is build our own plans.? By all means get insight and advice from peers, internal customers, leaders, and most of all from your own experience.? In a directional vacuum, build your own directions.? Then communicate that direction aggressively.

Chances are we have been told what is desired.? Probably, we have been given some interpretation of our personal responsibility for that desired outcome.? What we are likely lacking is a clear explanation of our authority, the tools or methods we can use, clarity of how resources or personnel will be made available or will cooperate, or what tactical strategy or priorities we should act upon.? Does that sound familiar?

As the first suggestion implies, don?t wait for those gaps to fill in, ask.? When no clear answers are forthcoming, make up your own answers.? Be bold.? Be courageous.? Be forthright with your answers and communicate your plan to everyone in your immediate circle of influence:? your leader, teammates, collaborators, and internal customers.

Here is an example of exercising both suggestions.? ?Agent Q? is a contributor without direct reports, is tasked with improving certain business metrics.? That is the extent of the direction provided.? Where should Agent Q begin?

Agent Q?s first frustration is that the business metric itself is not clear.? Different leaders seem to interpret it differently.? So Agent Q gathers an understanding from the various leaders and diagrams them for a consultation with his direct leader.? In that consultation he demonstrates the confusion and, therefore, the challenge and proposes the simplest calculation of the metric to be the standard.

Agent Q?s manager agrees to help and provides his own insight to the metric and who to approach first among the executive leaders to establish the standard.? While that negotiation is going on, at least Agent Q and his manager are on the same page about the metric.? While it may still change, Agent Q is not prohibited by confusion from proceeding, and personal risk has been mitigated.

Next, Agent Q faces the dilemma of executing something to make some changes and some progress toward the metric.? A number of managers have thrown out suggestions, but no clear priority exists, and no resolution or starting place has been dictated.? Agent Q must decide for himself.

He knows that he must explain and support his decision.? He makes a tool.? He establishes his own means of listing the various projects identified and sorting them according to a reasonable measure of their probable impact to the business metric.? Then he gathers a little data and quickly ranks the projects.

With a means available to rank projects according to value, Agent Q uses that to interrogate the business and it?s systems.? By investigating the causes for the metric and current performance, he comes up with his own set of potential projects to improve business performance and adds them to the list.

Now, he goes back to his boss and shares his insights.? The work done is not weeks or months of work, it?s hours or a couple of days; just enough to sketch out a proposed plan.? Agent Q?s manager provides some additional insight and even provides some direction.? The picture Agent Q was able to present inspires the manager?s sudden decisions and direction.

Agent Q now has some direction and priority agreed upon by he and his manager, and probably by higher-level committees once the prioritization is shared and explained.? So, with the metric clarified, priority established, and some assignments made, Agent Q is ready to engage.? Unfortunately, no one has thought that far either.

When Agent Q goes to the process owners he must engage to make the improvements at the top of his priority, how will they react, and how can he count on their cooperation?? The good news is that the clear metric and explanation of how the project will improve the metric should go a long way toward opening the door.? If that doesn?t work, Agent Q will need to work the management chain for assistance.? Again, the clarity of metrics and priority should help that process too.

In the face of, more-or-less, telling the management chain above him what he needed, or what must be done to facilitate his success, Agent Q is not the least daunted by the fact that no standardization exists for the tools or methods his training compels him to use to solve the problems and execute his projects.? He simply begins by experimenting, sharing with his peers, and eventually the group settles on some best practices.

Life as a change agent is certainly more complicated, at lease in dialogue, than the example above.? However, the reality of what needs to happen and what can and does happen is relatively simple.

Change agents, for many, many reasons, often do not have the luxury of a detailed plan for success.? Sometimes all we have are a vague vision, some technical training, and a deadline.? When we don?t have the direction, priority, resources, or agreement we need to proceed successfully, we must create our own.? There?s no whining in leading change (we get enough of that from those who resist).?

Be bold.? Tell your leadership what you need.? Propose plans and courses of action if you aren?t dictated some.? Share your insights unreservedly.? Don?t wait; master your fate.? Exercise your interpersonal influence to the greatest degree.? After all, your influence is probably what landed you the role.

(AP) ? World powers share a belief that Syria could descend into civil war and plan to map out possible ways to avoid such a disaster for the region, a deputy to international envoy Kofi Annan said Wednesday.

However, there was no indication that Russia, one of the veto-wielding permanent members of the Security Council, was changing its position on Syria.

Dmitry Peskov, President Vladimir Putin's spokesman, was quoted as saying by the ITAR-Tass news agency Wednesday that "there can be no talk" about a shift in Russia's stance on Syria under foreign pressure.

Russia, along with China, has twice shielded Syrian President Bashar Assad's regime from the U.N. sanctions over his crackdown on protests. Syria is Russia's last ally in the region, providing Moscow with its only naval base outside the former Soviet Union and a top customer for Russian weapons industries.

Guehenno, the Annan deputy and a former U.N. peacekeeping chief, also warned of the possibility of outside groups and terrorists taking advantage of the violence. "In any situation where there is a risk of civil war you have opportunistic actors, if one can say that, that can try to exploit that," he said.

Annan held talks with Assad in Damascus on Tuesday following the weekend massacre in Houla of more than 100 people, many of them women and children.

At the U.N. headquarters in New York, Germany's U.N. Ambassador Peter Wittig said Guehenno told the council that while Annan was in Damascus he appealed to the Assad

U.S. Ambassador Susan Rice said the worst but most probable scenario in Syria is a failure of Annan's peace plan and a spreading conflict that creates "a major crisis" not only in Syria but also region-wide.

"And members of this council and members of the international community are left with the option only of considering whether they are prepared to take actions outside of the Annan plan and the authority of this council," she told reporters.

The best scenario would be for the Syrian government to immediately start complying with the plan, she said, but that doesn't seem to be "a high probability."

And if Assad refuses to implement it, Rice added, then the Security Council should set aside its differences and up the pressure on Syria with added sanctions.

But Rice, Churkin and other council members agree the best scenario is full implementation of the Annan plan, with talks between opposing sides, despite the increasing worry that will never happen.

They also agree on the need for all sides to immediately halt the violence and for Syrian troops and heavy weapons to be withdrawn from towns and cities, with the government also providing access to detainees, journalists and humanitarian workers.

Annan said in Damascus that the situation has reached "a tipping point" and many council ambassadors agreed, including Rice.

"I think we may be beginning to see the wheels coming off this bus," she said.

Britain's U.N. Ambassador Mark Lyall Grant said Guehenno and one of his French successors, the current U.N. peacekeeping chief Herve Ladsous, provided a grim briefing.

Lyall Grant said there was a sense of "revulsion" at the weekend massacre and the increase in extremist attacks with a new sectarian element, all of which are throwing up roadblocks to Annan

"The key thing is unity of the council," he said, calling for discussion at the U.N. and in world capitals on how to avoid a civil war in Syria.

In this age of always on, we?re expected to be always on? Right?

Wrong.

I love the film Notting Hill, where Hugh Grants character has no job so fills his day up by spending time in "units" of half hour. Playing pool= 1 unit, watching Countdown =1 unit etc. As not many of us have the luxury of not working, here are some tips to help you keep up with delivering on a deadline but without offending anyone or having to stay late in the office during the hot summer evenings. Sherly Sandberg even leaves at 5.30.

Shake it up and get organised. These tips could save you up to two hours in you work day.

1. Decline a meeting. Time saved 45 minutes.

Typical Scenario: you've too many meetings throughout the day and can't seem to get any actual work done. This is a common problem for everyone and one that I've been known to experience and actually enjoy. You're busy so you must be important, right?

Wrong.

Your manager wants you to hit your deadlines. You need to pick the most important meetings with actual deadlines and focus on these. If you are being invited to meetings not directly related to your projects in a 'it would be good to have you there' type of way, thank the organiser for invite but decline politely and ask for the meeting notes.? That way you can have more time during the day, still catch up on what happened at any meeting you really didn't need to be at and move on with what the stuff you are actually being paid to do.

2. Cut out ?The swing by?. Time saved 10 minutes

We know them. They're fun, the swing by person in the office who swings by for a chat. We all need little break and we know all work and no play makes a dull siren. But seriously, if you re under pressure let them know you'll catch them at lunch or coffee or over the next few days. Again, 15 minutes saved.

3. Surfing the web. Time saved 30 minutes

Right so it's important to check into your social networks, but when you have a deadline, a couple of hours not tweeting what your doing, pinterest-ing your favourite places, facebooking your mates to tell them how great and interesting you are will not only save you time, but will actually MAKE you more interesting. You'll have more to rant about when you get home after you meet that deadline. And you'll get promoted for being so good at your job. Then you'll be rich and everyone wants to hang out with rich people.

4. Quit doing personal stuff in work. Time saved 30mins

As I said, we?re always on and your social life needs organising. But if you're the siren or dude who always ends up organising your mates at the weekend, let it go. Let someone else pick up the slack or wait until Friday and wing it.? Bit of spontaneity never hurt anyone.

5. Early lunch.... Time saved 30 minutes

This little trick has a double bonus. Not only do you miss the sandwich / lunch queue so an easy 10 minutes saved there, but go for a bit of fresh air in between and when you re ready to get back to work, everyone else will have cleared out. You can eat in peace and plough through some work in relative serenity. And look like you?re working through for extra brownie points. Job done.

Think about how you can make a real impact with those two hours in your day, just by these slight adjustments. Not every day but a good exercise to follow when you re under pressure.

Brand New Details On The Cardplaying Chessmaster Who Bagged JPMorgan's London Whale

Today's New York Times has a lengthy story, detailing the trader who helped bag JP Morgan's "London Whale."

If you don't know, JP Morgan recently announced that it had lost around $2 billion on some bad credit trades.? Reports surfaced that one of the players on the other side of those trades was legendary credit trader Boaz Weinstein.

The New York Times Azam Ahmed offers a lot of details on Weinstein's personal life and professional career. Some of which we knew; some we didn't.

Here's a round up of what was written about him:

  • He grew up in Manhattan's Upper West Side.
  • He earned the title of chess master when he was 16.? At a recent auction, he paid $10,500 to play chess with legend Garry Kasparov.? He plays online games with Silicon Valley venture capitalist Peter Thiel.
  • He won a stock-picking competition as a student in New York's prestigious Stuyvesant High School.
  • When he was 18, he failed to land a job at Goldman Sachs.? But then he was able to get more interviews after playing chess with a senior partner, whom he ran into at a bathroom.

  • As a credit trader at Deutsche Bank, Weinstein booked profits in 10 out of 11 years
  • In his heyday, he booked around $40 million in profits each year.
  • He earned the title of managing director at age 27.? At the time, he was the youngest MD in Deutsche Bank history.
  • During the height of the financial crisis, his team had lost around $2 billion.
  • In 2005, he won a Maserarti at a poker tournament sponsored by a unit of Berkshire Hathaway.? He still drives it.
  • He's banned from Las Vegas' Bellagio casino for counting cards at blackjack.
  • His hedge fund Saba Capital, has $5.5 billion under management and his offices are located on the 58th floor of New York City's Chrysler Building.
  • His wife, Tali Farhadian Weinstein, is a lawyer with the Justice Department.
  • In the hedge fund industry, Weinstein is known as a 'monster,' an unusually aggressive trader.
  • He's currently in talks to buy a $24 million apartment on Fifth Avenue.

Lenovo ThinkPad Edge S430 readies to enter Euro market, gets priced at ?809 on German site

A lot has happened since Lenovo unveiled its biz-oriented Edge S430 back at this year's CES, but after months of staying under the radar, it's finally looking like the laptop's ready to hit a few shelves around the globe. If a product page on Geizhals.at is to be believed, the Thunderbolt-loaded, 14-inch S430 is set to carry a €809 (about $1,015) price tag on one of the higher-end models, with this particular one showing a hot-off-the-press Ivy Bridge CPU (i5-3210M), NVIDIA GeForce GT630M graphics, 4GB of RAM and two USB 3.0 ports, among other things. Of course, this kind of cash is a slightly larger amount than, say, the $749 we heard when the machine was announced -- though, that's likely caused by the souped-up specs and could, as usual, vary depending on configuration. Either way, we have a feeling it won't be too long before we find out its official pricing and release date.

Well actually, the Hobbit preview wasn't shaky, it was smooth -- maybe too smooth -- and that's the point. "It does take you a while to get used to," Peter Jackson has admitted, referring to the surprisingly fluid motion of his 48 fps movie footage. But is he right to think audiences will even give it a chance? The launch of high frame-rate (HFR) cinema is surrounded by publicity in the run-up to the Hobbit's debut on December 12th, but it equally has a lot going against it. For starters, the film's 48 fps preview wasn't exactly received warmly. On top of that, the video-style apperance of HFR has a long history of being disliked by movie-goers -- past attempts since the 1970s have all flamed out.

85 years after the first 24 fps movies, the same number of frames are still going stubbornly through the gate (digital or otherwise) each second, so that must be what "filmic" is, right? Or will we look back on 24fps as the bad old days? Read on to see if these new/old-fangled frame speeds might survive, and though a 48 fps Hobbit trailer isn't available, we've provided a couple of clips to help you judge what two-dimensional HFR looks like.

Vatican in chaos after butler arrested for leaks

VATICAN CITY (AP) ? An already sordid scandal over leaked Vatican documents took a Hollywood-like turn Saturday with confirmation that the pope's own butler had been arrested after documents he had no business having were found in his Vatican City apartment.

The detention of butler Paolo Gabriele, one of the few members of the papal household, capped one of the most convulsive weeks in recent Vatican history and threw the Holy See into chaos as it enters a critical phase in its efforts to show the world it's serious about complying with international norms on financial transparency.

The tumult began with the publication last weekend of a book of leaked Vatican documents detailing power struggles, political intrigue and corruption in the highest levels of Catholic Church governance. It peaked with the inglorious ouster on Thursday of the president of the Vatican bank. And it concluded with confirmation Saturday that Pope Benedict XVI's own butler was the alleged mole feeding documents to Italian journalists in an apparent bid to discredit the pontiff's No. 2.

"If you wrote this in fiction you wouldn't believe it," said Carl Anderson, a member of the board of the Vatican bank which contributed to the tumult with its no-confidence vote in its president, Ettore Gotti Tedeschi. "No editor would let you put it in a novel."

The bank, known as the Institute for Religious Works, issued a scathing denunciation of Gotti Tedeschi in a memorandum obtained Saturday by The Associated Press. In it the bank, or IOR by its Italian initials, explained its reasons for ousting Gotti Tedeschi: he routinely missed board meetings, failed to do his job, failed to defend the bank, polarized its personnel and displayed "progressively erratic personal behavior."

Gotti Tedeschi was also accused by the board of leaking documents himself: The memorandum from the Institute for Religious Works, as the bank is known, said he "failed to provide any formal explanation for the dissemination of documents last known" to be in his possession.

In an interview with the AP, Anderson stressed that the latter accusation was independent of the broader "Vatileaks" scandal that has rocked the Vatican for months. But he stressed: "It is not an insignificant issue."

Gotti Tedeschi hasn't commented publicly about his ouster or the reasons behind it, saying he has too much admiration for the pope to do so. He also hasn't been arrested, avoiding the fate that befell Gabriele.

The 46-year-old father of three has been in Vatican detention since Wednesday after Vatican investigators discovered Holy See documents in his apartment. The Vatican spokesman, the Rev. Federico Lombardi, said Gabriele had met with his lawyers and that the investigation was taking its course through the Vatican's judicial system.

Gabriele, the pope's personal butler since 2006, has often been seen by Benedict's side in public, riding in the front seat of the pope's open-air jeep during Wednesday general audiences or shielding the pontiff from the rain. In private, he is a member of the small papal household that also includes the pontiff's private secretaries and four consecrated women who care for the papal apartment.

Lombardi said Gabriele's detention marked a sad development for all Vatican staff. "Everyone knows him in the Vatican, and there's certainly surprise and pain, and great affection for his beloved family," the spokesman said.

The "Vatileaks" scandal has seriously embarrassed the Vatican at a time when it is trying to show the world financial community that it has turned a page and shed its reputation as a scandal plagued tax haven.

Vatican documents leaked to the press in recent months have undermined that effort, alleging corruption in Vatican finance as well as internal bickering over the Holy See's efforts to comply with international norms to fight money laundering and terror financing.

The Vatican in July will learn if it has complied with the financial transparency criteria of a Council of Europe committee, Moneyval ? a key step in its efforts to get on the so-called "white list" of countries that share financial information to fight tax evasion.

Anderson acknowleged that the events of the last week certainly haven't cast the Holy See in the best light. And he said the bank's board appreciated that the ouster of its president just weeks before the expected Moneyval decision could give the committee pause.

"The board considered that concern and decided that all things considered it was best to take the action at this time," Anderson said. "These steps were taken to increase the IOR's position vis-a-vis Moneyval."

The Vatileaks scandal began in January when Italian journalist Gianluigi Nuzzi broadcast letters from the former No. 2 Vatican administrator to the pope in which he begged not to be transferred for having exposed alleged corruption that cost the Holy See millions of euros in higher contract prices. The prelate, Monsignor Carlo Maria Vigano, is now the Vatican's U.S. ambassador.

Nuzzi, author of "Vatican SpA," a 2009 volume laying out shady dealings of the Vatican bank based on leaked documents, last weekend published "His Holiness," which presented a trove of other documents including personal correspondence to the pope and his secretary ? many of them painting Benedict?s No. 2, Cardinal Tarcisio Bertone, in a negative light.

Nuzzi has said he was offered the documents by multiple Vatican sources and insisted he didn't pay a cent (euro) to any of them.

Gabriele was in Vatican custody and unavailable for comment. No known motive has come to light as to why Gabriele, if he is found to be the key mole, might have passed on the documents. Nuzzi declined to comment Saturday on whether Gabriele was among his sources.

Bertone, 77, has been blamed for a series of gaffes and management problems that have plagued Benedict's papacy and, according to the leaked documents, generated a not inconsiderable amount of ill will directed at him from other Vatican officials.

"For some time and in various parts of the church, criticism even by the faithful has been growing about the lack of coordination and confusion that reign at its center," Cardinal Paolo Sardi, the former No. 2 official in the Vatican secretariat of state, wrote to the pope in 2009, according to the letter cited in "His Holiness."

Anderson, who heads the Knights of Columbus, a major U.S. lay Catholic organization, said he was certain the Holy See would weather the storm and that the Vatican bank, at least, could move forward under a new leader with solid banking credentials as well as a desire to show off the bank's transparency.

"I hope this will be the beginning of a new chapter for the IOR and part of that chapter will be restoring the public image of the IOR," he told AP. "I think we have a good story to tell."

James Wilks, TUF winner and UFC veteran, retires after warns of possible paralysis

"The Ultimate Fighter" season nine winner James Wilks announced his retirement from MMA after doctors advised him he could become paralyzed if he continued to fight.

Wilks had a serious knee injury that kept him out of the Octagon. His last bout was a loss to Claude Patrick in October of 2010. When that healed, a neck injury from his rugby-playing days flared up and Wilks realized how serious previous warning signs were.

"I had problems in a couple of the fights that I didn't really talk about," he said. "In one of the fights, I got hit, and the whole left side of my body went numb, all the way down to the toes."

Even with the doctor's warnings, Wilks called the decision difficult, particularly because he went out on a loss. He went 1-2 in the UFC after beating DaMarques Johnson in the TUF finale. As more fighters age, they will be faced with the issue of retirement. Kudos to Wilks for being strong enough to walk away before he was damaged permanently.

Apple's iPad gives you numerous ways to take notes, from typing on the virtual keyboard to writing on the touchscreen with a stylus or your finger. The note-taking app Penultimate (99 cents), recently purchased by the note-syncing and storage app company Evernote, is one of the best iPad note-taking apps around. It's fast, friendly, flexible, and at less than a buck, a bargain, all reasons it's an Editors' Choice. Using the app is second nature because it's nearly the same as doodling in a paper notebook. While the app's touch-based sophistication will no doubt impress consumers, when paired with a touch stylus like the Kensington Virtuoso ($24.99), Penultimate can scale to the professional demands of engineers, architects, and industrial designers. Not to mention that the app is optimized for the new iPad's high-resolution retina display.

The Penultimate iPad app doesn't have a keyboard, so it's not useful for typing notes. And it isn't quite as feature-rich as our other Editors' Choice Note Taker HD ($4.99, 4.5 stars)?although the latter costs five times as much. (For more recommendations, see "Note-Taking Apps for the iPad.")

Broad Strokes
Penultimate's interface looks familiar, though if there's any uncertainty, an interactive walkthrough takes just a couple of minutes to complete. You write in a virtual notebook, filled with blank, grid, or lined pages. The tools, a pen?fine, medium, or broad tipped, in ten shades?and eraser follow your finger or stylus across the page. New pages appear when you flip forward by touching the top corner of a page. Flipping between pages is nearly as smooth as thumbing the pages of a physical book, a testament to the app's speed.

Also worth mentioning are two controls through which you can improve usage. From the settings,you can move the toolbar?buttons for clearing a page, writing, and erasing?from the bottom of a page to the top. There's also a clever feature called Wrist Protection, which, automatically disregards stray marks from a resting wrist. Sometimes, especially when doodling, Wrist Protection can be overly protective, ignoring quick swipes, but when it comes to writing, it's a must.

Finger Painting
Penultimate organizes your work in terms of "Notebooks." Accessing different notebooks is as easy as returning to "My Notebooks" and swiping through the covers. Inside a notebook, you can create as many pages as you like. Unlike a notebook that comes in one style?blank, lined, or grid?with Penultimate, you can alternate between the three paper background styles. An in-app connection to The Paper Shop allows you to buy additional paper styles, such as sheet music paper, should you choose. A few are free, but most cost about a dollar.

If you make mistakes, as you will at first while getting used to writing with your finger or a new stylus, you can use either an eraser or an "undo" button. Multiple undos are supported, thankfully, and a redo button lets you toggle back if you undo too many actions.

The Penultimate iPad app doesn't have handwriting-to-text OCR, as the app Notes Plus ($7.99) does. So if you write by hand, the text stays in your handwriting, for better or worse. The iPad display doesn't tent to make handwriting look any worse than it already is, and if anything, smooths it slightly. Penultimate is fine for quick notes, and amazing for sketching or mind-mapping, but we wouldn't recommend it for heavy writing.

Whether you're sharing in real time through a projector, distributing sketches as PDFs, or backing up files in iTunes, Penultimate is a capable companion. If you're looking to collaborate with colleagues, you can connect your pad to a projector via the Apple iPad VGA Adapter ($29). You can also share sketches via email. From inside a notebook, you can select either page or a full notebook to be attached as either a standard PDF or the proprietary .pen format.

Exported PDFs look great. There's even an option to include the paper background image, or convert it to flat white. You can import image files into your notebooks and mark them up with notes or just place them on a page and resize them however you want. Penultimate integrates well with Dropbox, Evernote (Penultimate is now owned by the company Evernote), and iTunes.

Your Last Pen
Penultimate for iPad, a PCMag Editors' Choice, is an excellent and ridiculously inexpensive note-taking app that is especially handy for those who have to sketch diagrams and images in their notes. Typists will lament the lack of a keyboard and should stick to Note Taker HD, our other Editors' Choice, instead. Tight integration with Dropbox and Evernote, two big players in the cloud syncing space, given Penultimate a little more utility than it would otherwise have on its own. Now that the product has been picked up by Evernote, we're excited to see what's in store next for this capable and already impressive app.
